Welcome to our website. If you continue to browse and use this website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern our relationship with you in relation to this website. If you disagree with any part of these terms and conditions, please do not use our website.

The term ‘Rachael Kelly Equestrian Accessories’ or ‘us’ or ‘we’ or ‘our’ refers to the owner of the website whose registered office is Ballakilley Farm, Ballasalla, Isle of Man, IM9 3AU. Our company registration number is 009058V. The term ‘you’ refers to the viewer or user of this website.

The use of this website is subject to the following terms of use:

Our products

The images of the products on our website are for illustrative purposes only. Whilst we have made every effort to display the colours accurately we cannot guarantee that your computer’s display of the colours accurately reflect the colour of the products. The products may vary slightly from the images.

All products shown on our website are subject to availability. We will inform you by email as soon as possible if the product you have ordered is not available and will not process your order.

As a consumer, you have legal rights in relation to products that are faulty or are not as described. Advice about your legal rights is available from your local Citizens’ advice Bureau or Trading Standards office. Nothing in these Terms will affect these legal rights.

These Terms and any document expressly referred to in them constitutes the entire agreement between you and us. You acknowledge that you have not relied on any statement, promise or representation made or given by or on behalf of us which is not set out in these Terms.

How we use your personal information

We only use your personal information in accordance with our Privacy Policy. Please see our Privacy Policy for further details.

How the contract is formed between you and us

Once you place an order, you will receive an email from us acknowledging that we have received your order and the contract between us is formed. If we are unable to supply a product to you for example because the product is out of stock, no longer available or because there is an error in the price on our site, we will inform you by email and we will not process your order. If you have already paid for the products we will refund you the full amount as soon as possible.

Our right to vary these terms

We may revise these Terms from time to time and every time you order products from us, the Terms in force at that time will apply to the Contract between you and us.

Whenever we revise the Terms in accordance with this clause we will keep you informed by stating at the top of the page that these Terms have been amended and state the relevant date.

Your consumer right of return and refund

If you are a consumer you have a legal right to cancel a contract under the Consumer Protection (Distance Selling) Regulations 2000 during the period set out below. This means that durig the relevant period if you change your mind or for any other reason you decide you do not want to keep a product, you can notify us of your decision to cancel the Contract and receive a refund. Advice about your legal right to cancel the Contract is available from your local Citizen’s Advice Bureau or Trading Standards office.

Your legal right to cancel a contract starts from the date of the Dispatch Confirmation, which is when the Contract between us if formed. If the products have already been dispatched or delivered to you, you have a period of 7 (seven) working days in which you may cancel, starting the day after the day you receive the Products. Working days means that Saturdays, Sundays or public holidays are not included in this period. To cancel a Contract you must contact us in writing by email or letter (see Contact Us for further details). If you send us your cancellation notice by email or post, then your cancellation is effective from the date you sent the email to us or posted the letter to us. You will receive a full refund for the price you paid for the product(s), if the products had already been dispatched or delivered to you they will need to be returned to us before the refund is given. We will process the refund due to you as soon as possible within a maximum of 30 calendar days upon receipt of the cancellation notice and if the products had been dispatched or delivered on receipt of the returned product(s). If you have returned the products to us because they are faulty or mis-described, we will refund the price of the defective product in full and any reasonable costs you incur in returning the item to us.

We will refund you PayPal account or your credit or debit card you used to pay via PayPal.

If the products were delivered to you:

You must return the products to us as soon as reasonably practicable.

Unless the products are faulty or not as described, you will be responsible for the cost of returning the products to us.

You have a legal obligation to keep the products in your possession and take reasonable care of the products while they are in your possession. As a consumer you will always have legal rights in relation to products that are faulty or not as described. These legal rights are not affected by the returns policy in this clause or these Terms. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office.

Delivery

Delivery will be completed when we deliver the products to the address you gave us. If there is no one home to accept the delivery our carrier / the post office will leave a card and you will need to collect the product from their local depot or you will need to arrange a re-delivery time with them directly.

The products will be your responsibility from the completion of the delivery.

You own the products once we have received full payment.

We offer free UK delivery on our products and if we receive your order before 1pm your order will be dispatched the same day (excluding Sunday’s and Public Holidays).

International delivery

Please contact us if you require delivery outside the UK. Delivery charges will apply and we will advise you what the charges will be once we know the delivery destination.

Please note that your order may be subject to import duties and taxes which apply when the delivery reaches your destination. You will be responsible for the payment of any import duties and taxes and we suggest you contact your local customs office to check what the costs will be prior to placing your order.

You must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable or responsible if you break any such law.

Price of products

The price of the Products will be as quoted on our website. We take all reasonable care to ensure that the prices of products are correct at the time when the information was entered onto the website.

Prices of our products may change from time to time, but changes will not affect any order which we have received prior to the change.

How to pay

You can only pay for products using either your PayPal account directly or your credit or debit card via PayPal.

Events outside of our control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an Event Outside Our Control.

An Event Outside Our Control is defined as any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

If an Event Outside Our Control takes place that affects the performance of our obligations under a contract:

We will contact you as soon as reasonably possible to notify you; and

Our obligations under a Contract will be suspended and the time for performance of our obligations extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our delivery of products to you, we will arrange a new delivery date with you after the event outside our control is over.
